- Abstract
The article discusses the case of the genetically modified (GM) Kentucky bluegrass that fell outside the regulatory authority of the U.S. Department of Agriculture. The case is noted to be the first time that a large company has taken advantage of the critical weakness in the regulation of GM plants. The grass maker Scotts Miracle-Gro is reported to have chosen the Kentucky bluegrass for the simplicity of both the genetic materials used to create it and the patent associated with it.
