- Abstract
The article examines the government mandated drug testing for welfare recipients in the U.S. that violates 4th Amendment of the U.S. Constitution and discusses the approaches that can be applied by courts in treating such cases. It analyses if the unconstitutional conditions doctrine poses a solution for it. It calls for a new constitutional analysis while suggesting that Courts should develop a test for 4th Amendment violations in the context of conditioned welfare benefits.
