- Abstract
In this article the author discusses the lawyer's right to withdraw in the decision of Supreme Court of Canada case R v. Cunningham. The author believes that the decision clarifies the ambiguity confining the counsel's right to withdraw a case, maintaining that the Court may exercise the discretion to refuse or allow the application of the counsel to withdraw for financial reasons. Also, the author discusses the ethical reasons that justify the right to withdraw of the criminal justice defence.
