- Abstract
This article examines the ethics of presenting and attacking expert testimony in the U.S. It looks at some of the rules of professional conduct regarding expert witnesses. It describes the ethical rules regarding cross-examination of an opposing expert witness. It also discusses the discourse concerning manufactured uncertainty that is usually associated with the regulatory arena. In addition, the article references a pre-trial hearing for the Supreme Court case Daubert v. Merrell Dow Pharmaceuticals Inc. that provides attorneys with the opportunity to engage in strategies.
