- Abstract
The article offers information on the Chapter 174 of California Legislature which constructs a separate mortgage fraud statute that offers a clear signal to mortgage brokers who defraud homeowners about the penalties for mortgage fraud crime. It states that Chapter 174 synthesizes a new public offense for mortgage fraud that only prosecutes the offenders when the value of the alleged fraud meets the threshold for grand theft. It notes that Chapter 174 demonstrates new ways on how prosecutor can collect evidence relative to mortgage crime. It also shows that chapter 174 systematizes the methods for production of records for prosecution.
