- Abstract
Peru's approach to criminal liability of legal persons and the applicable procedural regulations are subject to continuous development and interpretation in case law. However, there is no consensus to date on how to apply and interpret article 105 of the Criminal Code and even less certainty on how Law No. 30424 should be applied and interpreted. Although article 105 of the Criminal Code has been in force since 1991, it is only in recent years that interesting analyses have emerged on the procedural assumptions to implement ancillary consequences. In this article, we discuss that these analyses are based on contradictory criteria and, therefore, do not provide legal certainty.
