Error of judgment.
Abstract
The author reflects on the ruling of the European Court of Justice (ECJ) regarding the patents involving human embryo. The author argues that the ECJ' decision on the complaint filed by Greenpeace International against Institute of Reconstructive Neurobiology director Oliver Brüstle is not based on legal references. The author cites that the ECJ made a mistake on relying to a general definition of human embryo rather than legal terms in dealing with the said case.
