The origin of the pupillary and exemplary substitutions dates back to Roman Law. Both institutions have been traditionally controversial for the academic scholars and the case law with regard not only to the maintenance of their legal regulation in the Civil Code but also in wich it refers to the scope of their practical meaning. Nowadays both figures can be useful and justified as formulas to protect the rights of vulnerable people, child and people with disabilities.
