- Abstract
The European Court of Human Rights (ECHR) determined that Ukraine violated the right to respect for private and family life of the applicants in the case of Dubetska and others v. Ukraine. The applicants, residents in a rural area near a state-owned coal mine and processing plant, were exposed for many years to a high risk of diseases due to industrial pollution. Although Ukrainian authorities promised to relocate those affected to a safer area, there were delays in fulfilling this promise. The ECHR pointed out that the State had the responsibility to reduce environmental risks to safe levels and had shown delays and inconsistencies in addressing the pollution.
