- Abstract
The article focuses on the Consumer Law Survey of consumer privacy litigation in the U.S. in 2006. It says that reports of data security breaches were frequent in consumer privacy litigation. It notes that one trend from the cases is the difficulty experienced by plaintiffs in establishing that they have been damaged. Several decisions that stemmed from litigation as a consequence of a data security breach are discussed, including the case of Sovereign Bank versus BJ's Wholesale Club.
