- Abstract
This article presents a review on the court decision of the Delgado (Travelers Insurance Co.) case under Bronx County Supreme Court. In granting respondent's cross motion to vacate a lien of the New York City Health and Hospital Corporation, the Bronx County Supreme Court held that since insurance liability was based on contract and not the negligence of the insurance carrier, the statutory lien did not apply to a judgment based upon an award under the uninsured motorist endorsement. The court construed the statutory lien to allow an enforcement device on any recovery against a wrongdoer.
