- Abstract
The article presents an argument on the right to a fair trial on alleged terrorists at Guantánamo Bay Detention Camp in Cuba. It challenges restrictions on the right to a fair trial during Guantánamo Bay proceedings using teleological-deductive and inductive-comparative approaches. It discusses the relevant case law of the international courts and the U.S. Supreme Court and compares various human rights regimes and their rationale, especially international humanitarian law (IHL).
