Christian Louboutin SAS v Nakul Bajaj & Ors, High Court of Delhi, CS (Comm) No 344/2018, 2 November 2018 The Delhi High Court has further clarified the extent to which Indian e-commerce companies can rely on the safe-harbour provisions for trade mark infringement by sellers hosted on their platforms. They may be held liable for trade mark infringement if (i) they actively participate in the selling process or (ii) fail to exercise due diligence.
