- Abstract
The article examines the U.S. federal courts' interpretation of the 'special circumstances exception' used by debtors to avoid paying unsecured debts like student loans in bankruptcy cases. Also cited are the provisions of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA), the use of tests by bankruptcy courts to determine 'undue hardship' by debtors, and whether student loans qualify as 'special circumstance exception.'
