- Abstract
With the increased terrorist threat to national security this chapter argues in favour of the European Union (EU) introducing legislation directing its 28 Member States to comply with data retention of passenger name records (PNR) on flights out of and into Europe. The chapter begin by examining the current terrorist threat to Western states from Islamist groups, in particular that posed by Islamic State and Jabhat al-Nusra Front. As up to 5,000 EU citizens have gone to Syria and Iraq to join and fight with these groups and become ever more radicalised as they are imbued with extremist Islamist views, there is a very real danger that terrorist threats to the EU Members States will increase. As the chapter reveals, the recent terrorist events in January 2015 in Europe, especially with the Charlie Hebdo office and the Jewish Supermarket attacks in Paris reveals how difficult it is for states' national security and policing agencies to prevent attacks from happening and consequently keeping people safe. The chapter argues that one method of data collection added to intelligence systems that would assist counterterrorism investigators would be for the EU to reintroduce the 2011 PNR Directive that failed be passed through the European Union Parliament and onto the EU''s statutory provisions. The argument is that it is reintroduced with certain criteria to safeguard personal data form being misused and stored unnecessarily, such as it being solely related to terrorism investigations, request for the data only come through Europol and it is handled in accordance with the relevant law on human rights and fundamental freedoms.
