The article addresses the issue of whether the Americans with Disabilities Act (ADA) authorizes a disable litigant to file an employment discrimination claim against a state or local government pursuant to Title II of the ADA in order to avoid shorter limitations of Title 1. Topics covered include an overview of the history of the litigation on the issue and details on why resolution of this question needs an application of administrative law jurisprudence.
