- Abstract
The article provides an understanding of the Florida Rule of Criminal Procedure 3.850 motions and offers suggestions on how to prepare for their common allegations. It states that Rule 3.850 allows an individual person who has been tried and found guilty or who pleaded guilty or nolo contendere an opportunity to challenge his or her judgment and sentence and achieve post-conviction relief. To limit exposure to a finding of ineffectiveness, it is suggested that limitations must be put on filings.
