- Abstract
The article discusses the proposed addition of a statutory section to Chapter 10 of the Indiana Medical Malpractice Act to ensure that parties have a fair chance to present all viable theories of recovery to a court. Judge-made law (case law) and the Indian General Assembly are mentioned, along with the legal precedents set by the court cases Miller v. Memorial Hospital of South Bend and K.D. v. Chambers which deal with judicial discretion and a medical malpractice Panel requirement.
