- Abstract
The article discusses the U.S. patent law case Markman v. Westview Instruments Inc. (Markman) in relation to the author's views about a potential procedural reform to the patent litigation, claim construction, and appellate review processes in America as of 2017. U.S. patent and administrative laws are addressed, along with the relationship between patent claims and inventions. America's Court of Appeals for the Federal Circuit is assessed, as well as patent claim interpretation.
