- Abstract
The article argues that the issuance of decryption orders under the All Writs Act threatens to violate the separation of powers doctrine and also violates the freedom of third-party corporations not to assist. Topics covered include the history of the All Writs Act, including its predecessors as well as their common usage by federal courts before 1948, the applications of the Act in Supreme Court jurisprudence, and the Act's role as a gap-filling jurisdictional device for judicial review.
