- Abstract
The article focuses on Edward Cooper, reporter at the U.S. Civil Rules Advisory Committee, who proposed amendments to Rule 23 under the U.S. Rules Enabling Act. It states that Cooper emphasized on rules that affected both the Civil and Appellate Rules leading amendments to all the provisions in the federal Rules of Appellate, Civil, Criminal and Bankruptcy Procedure that specifies time. It further states that recent changes in rulemaking reflect on the working of the Rules Enabling Act. It mentions that operational changes such as increased public access, greater congressional interaction and increased reliance on empirical research occurred in the Civil Rules Committee during Cooper's tenure.
