- Title
REGULATION OF UNFAIR COMPETITION.
- Authors
Werner, Ray O.; Cohen, Dorothy
- Abstract
The article presents legal developments in marketing with particular focus on the regulation of unfair competition. One of the developments focuses on the cases of World Travel Vacation Brokers Inc. and Kingsbridge Media & Marketing Inc. which shows that companies engaging in false or misleading advertising may be subject to injunctions or restraining orders, as well as to having their assets frozen to ensure consumer redress. Another development describes the cases of Miller Brewing Co. v. Anheuser-Busch Inc. and G. Heilman Brewing Co. v. Anheuser-Busch Inc., which clarify what is needed to be successful in a trademark infringement case and whether a company is unlawfully using a trademark to gain a monopoly in a certain product market.
