- Abstract
The article presents information on legal developments in marketing relative to the regulation of price competition. In regard to price competition, the article discusses U.S. Supreme Court case The Great Atlantic & Pacific Tea Company (A&P) v. Federal Trade Commission (FTC) which is charged by the FTC with knowingly inducing and receiving discriminatory prices on private label milk, under Section 2(f) of the Robinson-Patman Act. The article notes that this section of the Act was developed in 1936 to answer to earlier actions by A&P. The importance of the Court's decision to hear the case is noted, as A&P has asked the Court to review the "meeting competition" defense, which the author finds of interest. Other cases are discusses in terms of marketing implications.
