RESTORING "LIFE, LIBERTY, AND THE PURSUIT OF HAPPINESS" IN OUR CONSTITUTIONAL JURISPRUDENCE: AN EXERCISE IN LEGAL HISTORY.
- Authors
Charles, Patrick J.
- Abstract
The article discusses the U.S. legal history of the principles of life, liberty, and the pursuit of happiness, focusing on foundational documents such as the U.S. Declaration of Independence and the Bill of Rights in the U.S. Constitution. The U.S. Supreme Court case McDonald v. City of Chicago is also addressed. The historical origins of the term happiness are reportedly attributed to philosopher John Locke and his pre-Declaration writings about governmental rule and sovereignty.
