- Abstract
The article explores decisions of the U.S. Supreme Court in cases which have sought to define the reach and coverage of section 10(b) of the Securities and Exchange Act of 1934. It examines divergent paths that U.S. lower courts have taken in applying the decision by the U.S. Supreme Court in the case Janus Capital Group Inc. v. First Derivative Traders. It analyzes the Supreme Court's decision in Stoneridge Investment Partners LLC v. Scientific-Atlanta Inc. concerning securities fraud.
