- Abstract
The article discusses the constitutionality of commercial/maritime arbitration as of January 2014, focusing on alternative dispute resolution (ADR) methods and efforts to enhance access to justice by permitting claimants to arbitrate claims that they could not afford to being in court. According to the article, the U.S. Congress passed the nation's Federal Arbitration Act in 1925 as a means of making arbitration an equitable alternative to litigation. Equal access to justice is also examined.
