- Abstract
The article focuses on the resolution of the legal case of the Access Fund vs. the United States. In the case the Court of Appeals affirmed a lower court holding banning recreational climbing at Cave Rock, a religious site. The court held that the ban could not be fairly perceived as an endorsement of the tribal religion, but rather that the Forest Service's limitation on climbing served the permissible secular goal of protecting cultural, historical and archaeological features of Cave Rock.
