- Abstract
One of the five pillars of Islam, the pilgrimage to Mecca (Hajj), necessitates the fulfilment of various conditions. These conditions, known as "vücup," "edâ," and "sıhhat," are detailed in Islamic jurisprudence. However, a unique situation has arisen in recent times. The increase in wealth in the Islamic world and the improved financial capabilities of Muslims have made the pilgrimage more accessible, leading to a significant rise in the number of people aspiring to perform Hajj. As a result, the limited infrastructure in Mecca and the locations where Hajj rituals are performed could not accommodate the overwhelming demand, leading to the introduction of a quota system. This quota system involves allocating a specific number of slots to each country based on the number of Muslims residing there, allowing only those within the quota to perform the Hajj pilgrimage. This system is deemed necessary to ensure safety, provide adequate healthcare services, and maintain the orderly performance of the pilgrimage for both Mecca and the pilgrims. Considering this situation, it is essential to address the legal implications when someone applies for Hajj but passes away while waiting due to the quota system. Is this individual considered responsible for the Hajj pilgrimage according to Islamic law, or are they exempt? These questions require careful examination. This research primarily aims to answer these questions. Since the foundation of this debate rests on whether the Hajj visa is a matter of obligation (vücup) or fulfilment (edâ), the study will focus on the role of the Hajj visa, the impact of the quota system, and the visa on the legal status of Hajj to reach a conclusion.
