- Abstract
This article discusses the law applicable to user-generated content in the U.S. It presents the case Viacom v. YouTube, which helped raise public awareness of the need to create a set of uniform standards and practices to govern user-generated content. It then examines and compares two proposed sets of such standards and practices: the Principles for User Generated Content Services and the YouTube Video Identification tool. It also analyzes the standards and practices in light of the fair use provisions of section 107 of the Copyright Act.
