- Abstract
The article focuses on the absolute pollution exclusion rule for losses stated at the Comprehensive General Liability (CGL) insurance policies in the U.S. It explores the brief history and development of the CGL pollution exclusion rule which began in the early 1970s, with details on its policy types for commercial insurance business. It discusses the interpretations and decisions of legal documents and U.S. courts to pollution exclusion clauses (PECs). It notes the willingness of the insurance industry to the usage of PEC to deny the coverage and defend themselves in any situation pertaining to pollutant definition. It advises business people to respond to the legal interpretations of PEC of a particular state. Litigations related to pollution exclusion are also cited.
