- Abstract
The article discusses the court case Pablo v. Ak-Chin Indian Community, wherein the Ak-Chin Indian Community Court held that the tribe's constitution guarantees same-sex marriage as a fundamental right of liberty. It discusses the inapplicability of the due process clause of the Fifth Amendment and the due process and equal protection clauses of the Fourteenth Amendment of the U.S. Constitution. It considers provisions of the Indian Civil Rights Act incorporated in the Ak-Chin Constitution.
