- Title
Standardization and Pluralism in Property Law.
- Authors
Davidson, Nestor M.
- Abstract
The article focuses on the standardization in property law as well as its foundationalism and dynamism. It describes the numerus clausus principle and the problems pose by standardization to prevail conceptions of property as a tool of resource allocation and as an expression of individual autonomy and identity. It examines the flurry of attempts to explain why standardization persists despite the concerns. Furthermore, it presents a pluralist perspective on the numerus clausus grounded in the principle's underlying regulatory function.
