- Abstract
The article examines the U.S. presidential confidentiality, a privilege enjoyed by U.S. presidents, and its impact to the decisions of the government. It was disclosed that the political safeguards originated from a review in a law article which argued that the political process, not the courts, should determine the constitutional balance between the federal government and the states. Meanwhile, it was noted that the emergence of political safeguards means that the national political process is intrinsically well adapted to retarding or restraining new intrusions by the center on the domain of the states. Moreover, it was stressed that the intervening decades have been witness to the discrepancies that has occurred in the government caused by the excessive presidential confidentiality.
