- Abstract
The article presents constitutional implications of managed health care in prison system. The U.S. government's responsibility to provide health care to prisoners arises under the Eight Amendment to the Constitution, which provides that cruel and unusual punishment inflicted. The prohibition on cruel and unusual punishment has developed for imposing affirmative duties on government, including the provision of services such as medical care to prisoners. The government's obligation to provide medical treatment for prisoners did not historically arise from the Eighth Amendment. The dramatic rise in health care costs has also raised concerns about funding the expensive treatment system within prisons.
