The article focuses on the issues surrounding true threat doctrine, along with the protections afforded to the free speech under First Amendment to U.S. Constitution. Topics discussed include analysis of intersection between First Amendment and criminal intent; Chaplinsky v. New Hampshire court case addressing same; and Elonis v. United States case concerning whether conviction of threatening another person over interstate lines requires proof of subjective intent to threaten.
