- Abstract
The article focuses on the U.S. Court of Appeals for the Ninth Circuit case of Kivalina v. ExxonMobil Corp., which highlights a public nuisance claim that was brought agaisnt energy producers and oil companies by the Kivalina tribe, Alaska. The claim was filed to seek monetary compensation for the damages that occurred due the adverse impact of greenhouse gases emissions on climate change. The U.S. Environmental Protection Agency's claims are no longer viable for air pollution emissions.
