- Abstract
The article discusses the U.S. Court of Appeals case Granite Construction Co. vs. U.S., which focuses on nonconforming concrete work. An overview of the American Concrete Institute (ACI) 301 "Specifications for Structural Concrete" relating to nonconforming work is presented. The court ruled that when a contractor substantially complies with a contract's specifications, the owner may not require replacement of the work if replacement would lead to economic waste.
