- Abstract
A case study is presented on the concept of mutuality of consideration in arbitration agreements in America, and it mention the U.S. Fourth Circuit Court of Appeals' determination that an arbitration provision in a Maryland home construction contract was unenforceable for lack of mutual consideration in the 2013 case Noohi v. Toll Bros. Inc. Federal jurisdiction in the U.S. is examined, along with the nation's Class Action Fairness Act and Federal Arbitration Act.
