- Abstract
The author questions further international treaty-making within the human rights field, based on the declining appeal and utility of treaty-making. There is an inherent contradiction in the human rights treaty-making, since the object of the exercise is to produce standards to govern the behaviour of states towards their citizens and others within their jurisdiction, and yet those same states are the decisive actors in the treaty-making process. The author argues that nonbinding initiatives, or soft law, is less state-centric and can be more inclusive, innovative and nuanced processes. An example of alternative standard-setting techniques is the work of United Nations Representative of the Secretary- General on Internally displaced Persons in developing a normative framework for internally displaced persons.
