- Abstract
The European legal framework on the issue of the children not attended by their parents gone to work abroad is very new, and it is mainly comprised of the European Parliament's Resolution from March 12, 2009. This resolution, as regards the application of the social security schemes, needs to be corroborated with Regulation 1408/71 on the social security schemes applied to employed persons and to members of their families moving within the Community, applicable to Romania since 2007. The Romanian legislation refers to the consequences of labor migration on the children left in the country of origin is Order 219 from January 15, 2006, on the activities of identification, intervention and monitoring of children unattended by their parents during their working abroad. The order, although it mentions the need for statistics, social worker's work tools, refers only to the parents that work abroad with a legal contract, through the Labor Ministry, and lacks effectiveness and efficiency. This is why an optimization is required, in order to make it applicable, through a de lege ferenda proposal.
