- Abstract
The article argues for the First Amendment to protect the ability of student-athletes to profit from their identities. Topics discussed are identity protection under the right of publicity, tension between the right of publicity and First Amendment, importance of freedom of expression for student athletes, protection provided by the commercial speech doctrine for student-athletes, and commercial speech rights of student athletes used against the National Collegiate Athletic Association (NCAA).
