- Abstract
David McBride, a former military lawyer, has been sentenced to five years and eight months in prison for taking and disclosing 235 documents that revealed alleged war crimes committed by Australia's special forces in Afghanistan. McBride's actions led to the publication of the Afghan Files by the ABC and the subsequent Brereton Inquiry, which identified 39 instances of alleged unlawful killings of Afghan civilians. McBride argued that he wanted Australians to know about the murders of Afghan civilians and the failure of Australian military leaders to address the issue. He was charged with national security offenses and criticized Australia's whistleblowing laws for providing no immunity from prosecution. McBride's defense team plans to appeal the conviction based on the narrow definition of duty in Australian legal doctrine.
