- Abstract
The article discusses the court case 14 Penn Plaza v. Pyett, wherein the issue surrounds on the role of labor arbitration to hear age discrimination claims on Ohio. The Supreme Court rules that discrimination claims could be diverted from federal court to labor arbitration, which significantly projects judicial interpretation under the arbitration clause. However, the court explains that labor arbitrator can only hear the case when the union representing the plaintiff pursues the case.
