- Abstract
The article focuses on the aspects of joint criminal enterprise (JCE) which had pushed the Office of the Prosecutor (OTP) to charge guilt collectively in one decision. It says that JCE seem to violate defendants' fair trial rights at the Tribunals and has reduced requirements for special intent required for genocide. It cites the case of former Lieutenant Colonel Aloys Simba which was among the first cases at the International Criminal Tribunal for Rwanda (ICTR) in which the OTP alleged JCE.
