- Abstract
The article examines the constitutionality of the U.S. Defense of Marriage Act (DOMA), a law prohibits the government from recognizing same-sex marriages for federal benefits. It outlines the joined forces between solicitor general Theodore B. Olson and lawyer David Boies to challenge California's Proposition 8, a constitutional amendment that eliminates rights of same-sex couples to mary. It cites other suits in the courts that raised issues on same-sex marriage such as cases of Smelt v. County of Orange and Gill v. Potter. Moreover, it mentions the argument of the federal government that the court intervention would interfere with the ongoing public debate about equal marriage.
