- Abstract
The Cyprus Treaty of Guarantee is among the acts which documented the disestablishment of colony regime and declaration of the independent Republic on August 16, 1960. The Treaty guaranteed the sovereignty, territorial integrity and security of the new State besides the state of the affairs established by the Basic Articles of its Constitution. To Greek side, the Treaty restricted the sovereignty of the state and underpinned the partition of communities. Therefore, the abrogation of it is a precondition to resolve the Cyprus Issue. For the minor Turkish side, a state of affairs was established to guarantee their political, social and economic rights. When it is impaired, Greeks could deprive Turks of their rights and degrade their status to a simple minority by exploiting Greek majority in the legislative, the executive and the judiciary. The aim of this study is to analyse the Treaty of Guarantee based on the understanding of international guarantee, irrespective of the positions of the sides. In this study, after defining the conceptions of "guarantee" the specifications of international guarantees will be discussed. Thereafter, Cyprus Treaty of Guarantee will be analysed against these specifications. This paper argues that the Treaty is in harmony with the understanding of the international guarantee.
