- Abstract
Jurisdiction of the courts in divorce matters with international element creates an uneven practice and a different interpretation of these laws. The different application of provisions from one court to another and poor interpretation of the rules when the rules of priority established by the CPC to intervene and those in the Supplementary Regulations EC 2201/2003 have the effect of declaring the general lack of jurisdiction of the Romanian courts, resulting in negative conflict of competence. This study aims to analyze the court's jurisdiction in matters of divorce, competence shown in the light of all the acts that are applicable in different situations, in our legislation.
