- Abstract
The article offers information on damage caps related to statutory causes of action and special proceedings of Illinois, and State's separation of powers. It informs that state separation of powers principles does not take part in the assessments of state statutory damage caps. It explains the infringement on judicial rulemaking authority regarding damages caps and also mentions that punitive damages are sometimes capped at amounts that are correlated with compensatory damages.
