- Title
Joint and Several Liability in Florida: Are Reports of Its Demise Greatly Exaggerated?
- Authors
Hooker, Michael S.; McConnell, Guy P.
- Abstract
The article focuses on the amendment related to the doctrine of joint and several liabilities in Florida. The change in regulation has fixed the apportionment of damages in negligence cases in accordance with the party's percentage of fault, rather than pursuant to the doctrine of joint and several liabilities. Now, the tortfeasor's degree of liability is generally limited to his or her own degree of fault. The approach adopted for the changes is called the comparative fault approach.
