The article focuses on the modernization of the mortgage foreclosure law in order to promote transparency and discard the self-contradictory treatment to the payment rule in mortgage foreclosure cases in the U.S. Topics discussed include laws for enforcement of negotiable instruments such mortgage backed securities (MBS), factors responsible for the Great Recession in 2008, and decisions of the Court of Appeals of North Carolina in Dobson and Simpson.
